Revisiting Cooperative Federalism

Relevance:

The contentious NPR which will lay the foundation of NRC has brought federalism  and more importantly cooperative federalism in to question. By the end of January 2020, atleast 11 states had expressed unwillingness to implement NRC. Article 355 instructs the Union govt. to ensure that the government of every state is carried on in accordance with the provision of the Constitution. Further Article 365 says that if any state fails to comply with the directions given in the exercise of the executive power of the Union under the provisions of the Constitution, it shall be lawful for the President to hold that a situation has arisen in which the Government of the State cannot be carried on in accordance with the constitution. These articles and the unwillingness of the states to implement NPR and NRC questions both federalism and cooperative federalism. The DIY is related to polity and governance of GSII.
